In reply to the second paragraph of Your Excellency's letter of 2nd. November, in which copies of letters from the Secretary of State for the Colonies, and the Secretary of State for Foreign Affairs are enclosed dealing with the pro- posal that Sir H. de Sausmarez should be a member of the Appeal Court of the Colony. Inow have the honour to submit the fol-
lowing remarks upon the proposal.
1.
The proposal is open to the very serious
objection that it practically makes an appeal lie from the Chief Justice of the Colony to a Judge foreign to the Colony. The new Appeal Court is only intended for appeals from Original
Jurisdiction, and all cases in Original Jurisdiction are heard
before the Chief Dustice; in case of difference of opinion
between himself and the Puisne Judge the casting vote is thus
to be transferred from the Chief Justice to the imported Judge,
which makes him the arbiter in all cases which are to be heard
before the new Court, where ar arbiter is necessary.
The ques-
tion takes a form quite different from that which it would assume, if there were 3 Judges in the Colony, for ther the Original Ju- risdiction work would be distributed between the Chief Justice
and the Senior Puisne Judge.
2.
The scheme will cause a great deal of con-
fusion, and in my opinion will prove to be impracticable» -

the existing Full Court must be retained not
merely for appeals from Surmary Jurisdiction; but also for inter -locutory matters in appeals to be ultimately heard by the New Court. It is essential also that it should be retained for ap-
peals from the Chief Justice in Chambers; otherwise it will open the way to appeals being made from Summary Judgments for the
